Provigil Lawsuit

A Brief Guide to Filing a Provigil Lawsuit:

What is Provigil?

Provigil is the brand name for Modafinil and is used to treat excessive sleepiness caused by narcolepsy—a medical condition that causes daytime sleepiness. Provigil is also combined with breathing apparatuses to prevent excessive sleepiness caused by sleep apnea or hypopnea syndrome—a sleep disorder were the patient briefly stops breathing and therefore doesn’t get a restful sleep. Provigil belongs to a class of medications called wakefulness promoting agents. The drug is effective by altering the amounts of certain natural substances in the region of the brain that controls wakefulness and sleep.

Provigil Side Effects:

Provigil side effects may present themselves regardless of adherence to intake instructions or dosage strengths. Please inform your doctor if any of these Provigil side effects are severe or persistent:

• Common Provigil side effects include: dizziness; headache; difficulty falling or staying asleep; nausea; constipation; gas; heartburn; loss of appetite; dry mouth; excessive thirst; difficulty moving; sweating; back pain; uncontrollable shaking of the body; burning, numbness or tingling of the skin; vision problems.

Provigil side effects may be classified as severe; if you experience any of the below Provigil side effects, call your doctor immediately:

• Serious Provigil side effects include: blisters; rash; peeling of the skin; difficulty swallowing or breathing; swelling of the throat, face, tongue, eyes, hands, feet, ankles or legs; chest pain; irregular heartbeat; hallucinating; depression; anxiety; suicidal thoughts.

This is not a full list of Provigil side effects. If you experience any adverse reaction or have any unusual problems while taking the medication you must call your doctor to discuss discontinuation. If you experience serious Provigil side effects, you or your doctor may file a report with the Food and Drug Administration’s MedWatch Adverse Event Reporting program at http://www.fda.gov/Safety/MedWatch or via phone at 1-800-332-1088.

Provigil and the FDA:

The Food and Drug Administration notified healthcare professionals in 2007 of an increased chance of developing a serious rash, including hypersensitivity reactions and Stevens-Johnson Syndrome. The FDA ordered a label change to reflect these Provigil side effects. Moreover, the FDA requested that Physicians should instruct their patients to discontinue use of Provigil and contact them if hypersensitivity or rashes occur.

Provigil Lawsuits:

The prescription medication Provigil was patented in 1990 and is officially approved for the treatment of narcolepsy and other sleeping problems. Moreover, the medication is also prescribed for other conditions not mentioned above, including cocaine withdrawal and depression. Potential Provigil side effects, when compared to similar medications, are regarded as marginal.

To date, there no notable Provigil lawsuits regarding the drug’s side effects have been filed by former patients. The only prominent Provigil lawsuits to reach court concern patents and generic equivalents. These Provigil lawsuits do not involve Provigil side effects, but instead patent violations. The bulk of Provigil lawsuits regarding patents question exclusive rights to manufacture the drug; ultimately this Provigil lawsuits was resolved when the parent company Cephalon reached an agreement with four manufacturers. These companies agreed to delay the release of a Provigil generic until 2012. In return, the Provigil lawsuit, offered the companies a percentage of the trademarked drug’s revenue.

Private consumers seeking Provigil lawsuits will have difficulty—because of the drug’s marginal side effects--securing a settlement. As stated before, no significant Provigil lawsuit has been reported concerning damages sought for the aforementioned side effects. Seemingly the only reaction that can lead to a Provigil lawsuit would be the development of Stevens-Johnson Syndrome. That being said, there have not been any public Provigil lawsuits concerning the development of this condition. If a user does file a Provigil lawsuit for Stevens-Johnson Syndrome, they are doing so in an effort to secure compensation. These funds—which are delivered as a Provigil settlement—are used to offset the costs associated with developing the condition.

In addition to limited side effects, Provigil lawsuits filed on behalf of users are unlikely because the drug is attached with appropriate warnings. Because of appropriate labeling, it is difficult to pursue litigation regarding Provigil generic or trademarked versions. Regardless, only an attorney experienced in pharmaceutical law can estimate your options for obtaining an out-of-court settlement from a Provigil lawsuit.
